General Terms of Use

These general terms of use govern the use of the Dockain service provided by International Business Sources.

1. Your Use of Our Services

Your use of Dockain products, the product website, dockain.com, and all other applications, software, services, websites, and other related services provided by us, dockain.com (collectively referred to as 'Services'), are subject to the terms outlined below and any other conditions applicable to the Services at any time (collectively, the 'Terms').
'We' or 'International Business Sources' means Dockain, Mouaada, Nefta, 2240, Tunisia.
'Subscriber' means a Dockain customer. 'User' means any user of the Services, including but not limited to subscribers, subscribers' customers, members of the Dockain forum, and individuals posting comments on the Dockain blog.
These terms and all documents referenced within them constitute the legally binding agreement governing the Services and your use of them. To use the Services, you must first accept the Terms. If you do not accept the Terms, you will not be able to access the Services.
Dockain will provide the Services only to subscribers who qualify as businesses. If you are a consumer subject to applicable consumer protection laws, you may not subscribe. By using the Services, Subscribers declare and warrant that they are not consumers. Some Services are available to Users other than Subscribers, but these Users are not Dockain customers, and Dockain has no responsibility towards them.

2. Privacy Policy

In general, you can use some of the Services without providing us with any information.
However, some Services require you to provide us with information about yourself. Some of the information we collect will be 'Personal Data,' meaning data about you that identifies you.
We may use your information for the following purposes: registering you for the Services; administering the Services and allowing you to use them; evaluating and analyzing your market, customers, products, and services; monitoring, reviewing, and improving the products and services we offer; internal record-keeping; and marketing purposes.
We collect information about you using various methods, including when you provide it through the Services, when you call or email us, or when you communicate with us by other means beyond the Services. We will only retain your information for as long as necessary or for the period required by contract or law.
We will not disclose your personal data to any third party without your consent, except in cases where it is necessary for our employees or business partners to provide you with a service on our behalf, or if we are legally obligated or permitted to do so.
We may use your information to provide you with details about products, promotions, and other relevant updates if you choose to receive this information via email or postal mail.
You can change your preferences regarding direct marketing at any time by opting out via each email or updating your user profile.
Dockain will act as the data controller. You can find Dockain's contact details in section 17 below.

3. Registration Data and Account Security

If you subscribe to the Services, you agree to (a) provide accurate, current, and complete information ('Registration Data'); (b) keep your password confidential; (c) maintain and update your Registration Data and any other information you provide to Dockain to keep it accurate, current, and complete; and (d) accept all risks of unauthorized access to your Registration Data. You are responsible for all activities on your Dockain account and any related charges.

4. Pricing and Fees

The pricing and all other fees for using the Services are described on the Services' website. They may be modified from time to time. In the event of a modification, we will provide you with at least 30 days' notice. If they are changed, your continued use of the Services after the modification takes effect will indicate your acceptance of the new pricing and fees applied. Pricing and fee changes will not apply to the billing period in which they occur.
All acquired Services are non-transferable and non-refundable. You will not be reimbursed for Services you do not use at the end of your subscription, even if your usage ceases immediately during an already paid billing period.

5. Ownership, User Content, Copyright, and Trademarks

All information, data, logos, trademarks, designs, graphics, photos, sound files, and other files, along with their selection and arrangement within the Services, are referred to as 'Content'. The Content provided by users, whether they are subscribers, subscribers' customers, or any other users, is referred to as 'User Content.
Except for User Content, the Services, all content, and all software available through the Services or used to create and operate the Services belong to Dockain or its licensors and are protected by Tunisian and international copyright laws. All rights to the Services, their content, and their software are expressly reserved. All trademarks, registered trademarks, product names, and company names or logos mentioned in the Services belong to their respective owners.
Your User Content is your responsibility. We assume no responsibility for it or for any loss or damage that your User Content may cause to others.
The Services may contain discussion forums, electronic bulletin boards, analytics services, or other forums where you or third parties may submit User Content. User Content posted in any public area of the Services will be considered non-confidential. You expressly agree not to send, transfer, transmit, distribute, store, create, or publish through the Services any illegal or offensive materials, promotions or advertisements, private information of third parties, viruses, or any other harmful material, among other content that may be considered inappropriate.
Although we are not obligated to do so, we reserve the absolute discretionary right to remove, monitor, or modify any User Content submitted or stored on the Services without notice, at any time and for any reason. You are solely responsible for keeping copies and replacing any User Content that you submit or store on the Services.

6. Your Limited License of User Content to Dockain

By posting or distributing User Content to or through the Services, you (a) grant Dockain and its affiliates a non-exclusive, royalty-free, transferable right to use, display, perform, reproduce, sublicense, distribute, publish, modify, adapt, translate, and create derivative works of this User Content as needed for the purposes for which the Services may use it from time to time; (b) declare and warrant that (i) you own and control all rights to the User Content you post or distribute, or that you otherwise have the legal right to publish and distribute this User Content to or through the Services; and (ii) the use, publication, or any other transmission of this User Content does not violate these Terms and does not infringe upon any rights or cause harm to any person or entity.
If you send to Dockain or post on the Services, in any public area, any information, ideas, inventions, concepts, techniques, or know-how ('User Submitted Information') for any purpose, including the development, manufacturing, and/or marketing of products or services incorporating such information, you acknowledge that Dockain may use the User Submitted Information without notice or compensation to you, and you waive any claim of ownership, compensation, or any other rights you may have regarding the User Submitted Information. We actively review User Submitted Information for new ideas. If you wish to protect any interest you have in such information, you should not submit it to the Services or to us.

7. Our Limited Content License to You

Dockain grants you a limited, revocable, non-exclusive, and non-sublicensable authorization to access the Services in order to view, copy, and print portions of the Content made available to you through the Services. This authorization is subject to these Terms and specifically conditioned as follows: (i) you may only view, copy, and print portions of the Content intended for your personal use; (ii) you may not modify or create derivative works from the Services or the Content, nor reproduce, distribute, or display the Services or any Content (except for page caching) unless expressly permitted by these Terms; (iii) you may not remove or modify any copyright, trademark, or other ownership references present in the Content; (iv) you may not use data mining, robots, or similar data gathering or extraction methods; and (v) you may not use the Services or Content for any purpose other than their intended use.

8. Payment Information

Dockain does not store any credit card information unless the subscriber enters their credit card details into the automatic billing option of Dockain's recurring profiles module.
Dockain strives to ensure the security of all credit card data and other confidential information, but it cannot assume any responsibility for the reliability of hosting services, Internet intermediaries, your Internet service provider, or other service providers. By using Dockain, you acknowledge that Dockain is not responsible for the security of your credit card information (except in cases of gross negligence or willful misconduct by Dockain).

9. Third-Party Sites and Advertisements

The Services may contain links to third-party websites ('Third-Party Sites') and third-party content ('Third-Party Content') as a service to users interested in this information. You use links to Third-Party Sites and any third-party content or services provided through these links at your own risk. If you leave our website or associated applications, our terms and policies will no longer apply. You should review the applicable terms and policies, including data collection and privacy practices of any Third-Party Site, and conduct any research you deem necessary or appropriate before engaging in any transaction with a third party.
Dockain may display advertisements and promotions from third parties on the Services. Your business dealings, correspondence, or participation in promotions of advertisers other than Dockain, and any terms, conditions, warranties, or representations associated with such dealings, are solely between you and those third parties. Dockain assumes no responsibility for any losses or damages that may result from such transactions or from the presence of third-party advertisers on the Services.

10. Disclaimer of Warranties

The Services and Content are provided to you 'as is', without any warranty of any kind from Dockain, whether express or implied. Dockain expressly disclaims all other warranties, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Services will be (i) compatible with all or any of the computer systems and software you may use; (ii) available at all times or at any given time, uninterrupted, secure, or error-free; or (iii) suitable for your requirements or any specific level of performance or functionality. We reserve the right to withdraw or modify the Services at any time.
Dockain makes every effort to ensure that your access to and use of the Services is secure, but Dockain does not represent or warrant that the Services or any Content will be free of viruses or other harmful elements.

11. Limitation of Liability

We are only liable to you for direct losses that you may incur as a result of our breach of these Terms.
Our liability to you shall in no event include indirect damages or losses, or any commercial losses you may suffer, including but not limited to loss of data, loss of profits, or loss of business operations. In any case, our liability to you for any breach of these Terms, negligence, or any other fault shall not exceed the amount of fees you have paid to us during the relevant billing period (which cannot exceed twelve months).
Subscribers may perform calculations (e.g., tax forms, for notification or reimbursement purposes, for our accounting) using the Services. The results of these calculations will depend on the information entered by the subscriber and the functions and formulas used to perform the calculations within the relevant Services. Subscribers are solely responsible for providing accurate and complete information for such calculations. Dockain assumes no responsibility for the accuracy or completeness of calculations, tax forms, or reimbursements generated through the Services, regardless of whether any inaccuracy results from incorrect information entered by a subscriber or from the functions or formulas used in the calculations. The subscriber must verify the correctness of all calculations.
By using the Services, you agree to indemnify and hold Dockain and other companies and corporations within the International Business Sources group harmless from any costs, damages, claims, liabilities, and reasonable expenses incurred due to your breach of these Terms and/or any other applicable conditions governing the Services.

12. Communications

Dockain may communicate with you via email, WhatsApp, or in-service notifications.

13. Changes to Terms

Dockain reserves the right to modify these Terms by updating them on its website or by notifying you via email or other means. You are encouraged to review these Terms periodically to check for updates. If we make changes to the Terms that may significantly affect you, we will provide reasonable notice before the modification takes effect. Your continued use of the Services will constitute acceptance of all modified or updated Terms.

14. Governing Law and Jurisdiction

These Terms and your use of the Services shall be governed by Tunisian law, without regard to conflict of law provisions. The Court of First Instance of Tunis shall have exclusive jurisdiction over all disputes, claims, or any other matters related to these Terms or your use of the Services.
If you choose to access the Services from countries other than Tunisia, you are responsible for complying with all local laws of that jurisdiction, and you agree to hold Dockain harmless from any liability resulting from your failure to comply with such laws.

15. Inactive Accounts and Termination

If your account remains inactive for at least 12 months, you may choose to deactivate it. Deactivated accounts are not deleted – they are retained and can be reactivated. If we decide to deactivate your account, we will notify you via email. If your account remains inactive for an additional 12 months after being deactivated, we may terminate it without further notice.
You may terminate your use of the Services and your customer relationship with Dockain at any time. If you terminate your use of the Services, you will be required to pay any applicable fees for the current billing period.
Dockain will not issue any refunds if you terminate your use of the Services, even if you do so with immediate effect during an already paid billing period.
Notwithstanding any provision in these Terms, Dockain reserves the right, without prior notice and at its sole discretion, without notification or liability to you, to (a) terminate your right to use the Services or any part thereof; (b) block or prevent your future access to and use of all or part of the Services or Content; (c) modify, suspend, or discontinue any aspect of the Services or Content; and (d) impose limitations on the Services or Content.
If these Terms expire or are terminated for any reason, Sections 5, 8, 10, 11, 14, 15, and 16, as well as any representations or warranties made in these Terms, shall remain in effect indefinitely.

16. Miscellaneous

If any provision of these Terms is found to be illegal, void, or unenforceable for any reason, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. Dockain may assign all or any of its rights under this agreement to any party without your consent. You are not permitted to assign any of your rights or obligations under this agreement without obtaining prior written consent from Dockain, and any such attempted assignment shall be considered null and void. These Terms constitute the entire agreement between you and Dockain regarding your use of the Services and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Dockain concerning your use of the Services.
